TERMS AND CONDITIONS

The terms and conditions in this document outline the obligations and relative intentions of the seller, ‘konopiUS’ and the customer, or ‘BUYER,’ of konopiUS industrial hemp seeds. konopiUS reserves the right to change these or modify these conditions at any time. In the case of modification or amendment to this agreement, the BUYER will be contacted.

CONDITIONS OF HEMP SEED PURCHASES

Any reproduction of the certified commercial seed sold by konopiUS is strictly prohibited. This also includes using the certified commercial seed as part of a breeding program, or as parents, or for crossing genetics.

Reselling of hemp seeds sold by konopiUS is prohibited without a valid hemp seeds distributor license, submitted to konopiUS for its review and approval, not less than 14 business days before commencement of reselling or distribution. 

VARIETIES 

The following varieties are expected to be available for the 2024 season:

Fibror 79, Futura 83, Muka 76, Santhica 70, USO 31, Earlina 8FC, Fédora 17, Félina 32, Férimon, Orion 33.

KonopiUS cannot guarantee the availability of the selected variety.

CERTIFICATIONS

konopiUS EU certified industrial hemp seeds come with a certification for germination and have been tested for cannabinoids which can be accessed through konopius.com.

Non-GMO

No seeds distributed or sold by konopiUS are genetically modified organisms. 

PRICES

The price of the seeds sold will be honored for the period of time listed on the invoice from konopiUS which will include a validation period for the invoiced goods. The price of the seed sold via online platforms will be honored at the time of the sale.

konopiUS reserves the right to change to its price list at any time but will endeavor to invoice the goods ordered at the price listed on the order when it is placed.

Shipping cost is calculated based on weight, volume, insurance and the location of the delivery address. konopiUS cannot be held liable for supply chain disruptions in shipping or modifications of calculated costs should the logistics companies amend their pricing.

PAYMENT 

Orders must be paid in full upfront and prior to shipping.

For website ordering please follow the online steps. Payment shall be accepted online through the website or payment options may be arranged through a separate payment gateway, for example: Bank transfer, zelle or paypal options.

You will receive a proforma invoice after placing an order with a sales agent. Your advanced order is valid after the proforma invoice is paid. Your order is cancelled automatically if the proforma invoice issued is not paid by the due date. The final invoice for balance (transport costs, price change, extra analysis appearance, etc. see below) must be paid prior to the shipment. 

ORDER CANCELLATION

For online payments your order can be canceled anytime prior to shipping via the payment option available at time of check oout. Your order is cancelled automatically if the proforma invoice issue is not paid by the due date or at local pickup.

If konopiUS cannot fulfill your advanced order or find a suitable replacement, konopiUS will refund your payment. 

In the event of BUYER cancellation after payment has been submitted konopiUS cannot guarantee return of full payment and will work with the BUYER for an amenable solution.

PACKAGING

Original bags - Original packaging is in 55lb, tri-layered bags. For large order fulfillment these bags will not be repacked by konopiUS unless expressly agreed upon.

Repacked bags for USA fulfillment come in the following sizes: 1lb, 5lb, 10lb, and 25lb.

DELIVERY

Online orders are dispatched through UPS or USPS; multiple options available upon check out. For orders under 20,000 pounds, inventory will be dispatched from within the United States. For orders over 11 tons, freight arrangements will be made from Europe. If not requested otherwise, konopiUS uses economy road transport for continental USA deliveries.

After your order is dispatched, you will receive tracking information including estimated delivery time via email. 

The BUYER must inspect the order upon delivery to determine the goods have arrived without damage or defect.

In the event the shipment is damaged, please make certain to document the damaged or destroyed condition in writing on the delivery notice including photos. When placing a complaint, konopiUS requires photos of the damaged shipment and the delivery note. konopiUS will handle complaints and damaged shipments individually according to the claim results with the delivery company. 

LEGAL NOTE

konopiUS is governed by the laws as set forth by the state of North Carolina. konopiUS distributes only legal and EU certified hemp seeds on the plant database variety list. Therefore, konopiUS is not responsible for any legal issues that might appear after dispatching the order, neither for the possible fees towards konopiUS or your company, further, konopiUS will not be responsible for the purchaser’s legal fees in the event of a dispute. The responsibility for meeting legal restrictions of ordered material is the responsibility of the customer. konopiUS will endeavour to provide its commercially reasonable assistance as needed and requested.

Seed sales are regulated state by state regulation laws and under the USDA.
